These changes have come off the back of the original legislative change established by way of the Police Powers and Responsibilities (Jack’s Law) Amendment Bill 2022, named in honour of 17 year old knife crime victim, Jack Beasley…. now commonly known as ‘Jack’s Law'. Random metal detection wanding’s are authorised without a warrant and have previously been restricted to the Safe Night Precincts, public transport and public transport hubs.
The expansion now includes shopping centres, licenced premises, high-risk retail outlets, sporting and entertainment venues, that experience high pedestrian density. The legislation also seeks to restrict knife sales to minors, extending liability to retailers. Retailers are required to view photo ID prior to purchase, with those found to be non-compliant, facing 430 penalty points or fines of up to $67,746.
'Wanding' averages 1 to 2 minutes per person, with no physical contact required by police. Since Jack’s Law passed in 2023, more than 72,000 people have been wanded during operations, with 1,950 people charged with offences. This expanded policy however hasn’t come without debate, with concern these laws can create an overreach of police powers with the risk of racial profiling. Further, currently there is a lack of evidence that these measures are in fact impacting the reduction of violent crime within the community.
