What is fraud?

The Queensland Criminal Code defines fraud as an act where a person gains a benefit or causes a loss to another person dishonestly through deception, false or misleading representation or other fraudulent means. Fraud can be committed against individuals, businesses and even the government if the accused acted dishonestly and:

  • Uses property belonging to someone else
  • Obtains property belonging to someone else or is in another person’s possession
  • Persuades someone to deliver property to any person
  • Convinces someone to do or abstain from doing something that person is lawfully entitled to do
  • Causes a financial or other gain or detriment for any person
  • Takes property lawfully supplied or a service lawfully provided with the intent to avoid payment despite knowing payment is required immediately
