What is assault?

An act of assault under the Queensland Criminal Code is the application of force to another person without that person’s consent or with consent obtained by fraud or duress.

To simplify, an assault is usually committed by touching any part of the body. An assault can also include a threat to assault another person where the person has the ability to carry out the assault. 

There are several categories of assault offences, those being:

  • Common assault
  • Assault causing bodily harm
  • Unlawful wounding and grievous bodily harm
  • Sexual assault

Common assault usually refers to the act of hitting or threatening someone. Usually, common assault only involves minor injuries such as a scratch.
